NSSF Loses Lubowa Land Court Case

The National Social Security Fund (NSSF) has lost a court case in the controversial Lubowa land.

Court found that the evidence given by the former commissioner Survey and mapping that the land FRV 420 FOLIO 13 block 269 Plots 323,274,1322 was never vectorized in the system for reason that the deed plans were never issued by his office and that the land title has three deed plans without instructions to survey the land as required by law.

This case has been before Makindye Grade I Magistrate Arinaitwa Elisha, who dismissed the case after finding that there is no case to answer and acquitted the accused persons.

These are Lubowa Mohammed Kityo, Bogere Moses, Namanya Betty,Nakanwagi Daphine and Onyango Patrick.

The accused persons were charged with the offense of fraudulent procurement of a certificate of title contrary to section 190(1)of the registration of the Titles Act 230 laws of Uganda.

Court further found that the accused persons’ certificate of title was the first to be registered in the system.

The land in question is found in Lubowa in Wakiso District.

Counsel Jason Njeru Kiggundu confirmed that the accused persons have been absolved of the allegations of fraudulently obtaining the certificate of title and they are the genuine owners of the land.

In 2023, the former National Social Security Fund (NSSF) managing director, Richard Byarugaba, faced a tough moment as members of parliament (MP) sitting on the select committee probing the alleged mismanagement of NSSF money quizzed him about the Lubowa housing project.

The committee led by Mbarara City South MP, Mwine Mpaka, probed NSSF’s expensive idle housing unit project at Lubowa worth $62m constructed to attract high net worth individuals.

The committee said the project is supposed to have 2700 lifestyle complex housing units but only 303 units are complete.
