Tough Conditions Set As Gen Kayihura Is Granted Bail

The General Court Martial has Granted Bail to the Former Inspector General of Police, Edward Kale Kayihura. The bail was granted following an application by Kayihura’s lawyers led by Peter Kabatsi, who fronted old age and poor health as the main reasons for the applications.

A panel of 7 Army Officers chaired by Lt Gen Andrew Guti granted the bail application on the ground that the prosecution had not submitted any written objection. Lt Guti, however, said that despite the nature of offenses that Kayihura was charged with, it was his constitutional right and he had ever been convicted of any offense in any court.

“This court has taken note that the offences against Kayihura are of a serious nature and attract a serious penalty of death upon conviction but however, has also considered at the argument of the applicants,” Lt Gen Guti.

However, Kayihura’s movement is restricted to the districts of Kampala and Wakiso unless with permission of the court. He is restricted from traveling out of the country without permission from the court or army leadership.

He was released on a recognizance of 10 million Shillings none cash while the sureties are bonded at 5 million Shillings, not cash. He will be reporting to court once every month and coming to court as and when the court deems fit.
Kayihura presented three sureties whom he said were substantial and could represent him to court as and when the court deems fit. The sureties included; Maj Gen Samuel Kavuma, the  Deputy Commander Land Forces, Maj Gen James Mugira, the Managing Director of the National Enterprise Corporation and Rosemary Tumusiime, the Member of Parliament for Entebbe Municipality.
